Surrogacy law in Kenya
Many countries have laws against the practice of surrogacy. Kenya however, is not one of them. Kenya has been open-minded about surrogacy for years and welcomes intended parents who are looking for a ray of hope in their life. Kenyan government considers surrogacy as an option for childless couples to have a child biologically connected to them.
According to Kenyan government rules, a legal contract has to be drawn between the surrogate and the intended parents. This surrogacy contract is created to ensure a safe and transparent pregnancy cycle.
As per the agreement drafted, the surrogate mother is responsible for carrying the foetus to term and handing over the custody of the new-born to the intended parents with no clause. The contract also conditions that the intended parents have to bear all expenses of the surrogate mother during the pregnancy term. This includes the dietary requirements, clothing, travel, accommodation, remuneration to the surrogate, and medical expenses.
Intended parents need to pay the first instalment of the agreed payment before the egg transfer and rest of the amount after the first ultrasound of a successful pregnancy.
The surrogacy treatment is only initiated once the agreement is drawn, and both parties agree to the terms.
